Federal Court Rules That Anti-Muslim Activist Laura Loomer Fraudulently Joined CAIR-Florida in Lawsuit

(MIAMI, FL, 10/22/19) – The Florida chapter of the Council on American-Islamic Relations (CAIR-Florida), the state’s largest Muslim civil rights advocacy organization, today welcomed the U.S. District Court for the Southern District of Florida’s order dismissing a lawsuit filed by anti-Muslim right-wing activist Laura Loomer against CAIR-Florida.
 
The court determined that the Florida civil rights organization was fraudulently joined in the lawsuit against Twitter and CAIR’s national headquarters in Washington, D.C. which is still litigating the matter. CAIR-Florida was represented by Intellectual Property Attorneys Darren and Kain Spielman.
 
In his order, United States District Judge Rodolfo Ruiz wrote in part:
 
“Because Plaintiffs do not plead any facts supporting a claim against CAIR Florida, nor offer any evidence to rebut Defendants’ contention of fraudulent joinder, there is no possibility that a state court would find the Amended Complaint states a cause of action against CAIR Florida.”

CAIR-Florida’s civil rights attorney, Omar Saleh, stated:
 
“We’re pleased the court acknowledges that CAIR-Florida was fraudulently joined in this lawsuit. If one reads the complaint filed by Ms. Loomer, it can’t be mistaken for anything other than rantings of an individual’s irrational hatred of CAIR and Muslims. It includes baseless allegations that CAIR-Florida conspired with CAIR in Washington, D.C., and Twitter to tortuously interfere with a business, which unfortunately profits on disseminating hateful anti-Muslim rhetoric.”
 
The attorney added that such conduct, “. . .serves no purpose in our society and should not be a way to make money; it’s definitely not journalism and there is much more important work to be doing.”
